1. INTRODUCTION AND ACCEPTANCE
1.1 Company Information
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and RED G GLASS INC, a Utah incorporated company (“Red G Glass Inc,” “we,” “us,” or “our”), with its principal place of business at 2158 W 2300 S, West Valley City, UT 84119. 1.2 Acceptance of Terms
BY, CLICKING “SUBSCRIBE,” COMPLETING THE REGISTRATION PROCESS, OR OTHERWISE ACCESSING OR USING THE RED G GLASS INC WINDSHIELD PROTECTION PLAN SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.
1.3 Electronic Agreement
You agree that these Terms constitute an electronic agreement as defined by the Electronic Signatures in Global and National Commerce Act and that your electronic acceptance has the same legal effect as if you had physically signed these Terms.
1.4 Updates to Terms
Red G Glass Inc reserves the right to modify these Terms at any time. We will provide notice of any material changes through our website, email, or other reasonable means. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms. The most current version will always be available on our website at www.redgglass.com/terms-of-service.
2. SERVICE DESCRIPTION AND COVERAGE
2.1 Windshield Protection Plan
Red G Glass Inc provides a windshield protection plan service (“Plan”) that covers windshield chip and crack repairs and, under certain limitations, full windshield replacements. The Plan is not insurance and is not a warranty of any product or service purchased elsewhere. It is a service contract between you and Red G Glass Inc for the coordination of repair services through Red G Glass Inc.
2.2 Coverage Scope
Subject to the limitations and exclusions set forth in these Terms, your Plan includes:
1. Unlimited chip and crack repairs during the Plan term; and
2. $50.00 Discount on windshield
3. $50.00 Discount on calibration
4 $50.00 Discount on deductible
2.3 Service Limitations and Exclusions
The following limitations and exclusions apply to all Plans:
1. Pre-existing damage is not covered. “Pre-existing damage” means any damage that existed prior to the submission and approval of your initial windshield photos as described in Section 3.3;
2. Damage to any glass other than the front windshield (including but not limited to side windows, rear windows, sunroofs, or panoramic roofs) is not covered;
3. Damage resulting from collision, vandalism, theft, or any intentional act is not covered;
4. Damage resulting from manufacturing defects or product recalls is not covered;
5. Damage resulting from improper installation or repair is not covered;
6. Damage resulting from normal wear and tear, including but not limited to minor scratches, pitting, or wiper marks, is not covered;
7. Damage to windshield-mounted accessories, sensors, cameras, or other equipment is not covered;
8. Damage occurring while the vehicle is being used for commercial purposes, including but not limited to rideshare services, delivery services, or other business uses, is not covered;
9. Consequential damages, including but not limited to water damage, interior damage, or electrical system damage, are not covered; and
10. For Repair Only plans, chips that are deemed unrepairable by Red G Glass Inc or its approved partner shops due to size, location, depth, or other technical factors are not covered. Red G Glass Inc reserves the right to determine whether a chip is repairable based on industry standards and the professional judgment of approved partner shops.
2.4 Geographic Coverage
The Plan is valid only for vehicles registered and primarily operated within the United States. Services must be performed by Red G Glass Inc-approved partner shops located within the United States.
3. ELIGIBILITY AND ACTIVATION REQUIREMENTS
3.1 Vehicle Eligibility
The Plan is available only for personally owned passenger vehicles used primarily for personal, family, or household purposes. The following vehicles are not eligible for coverage:
1. Commercial, business, or fleet vehicles;
2. Vehicles used for business purposes, including but not limited to rideshare services, delivery services, or other commercial activities;
3. Vehicles with a gross vehicle weight rating (GVWR) exceeding 10,000 pounds;
4. Motorcycles, recreational vehicles (RVs), trailers, or mobile homes;
5. Antique vehicles, collector vehicles, or vehicles not in regular use;
6. Vehicles with custom or non-standard windshields; and
3.2 Vehicle Information Accuracy
You must provide accurate and complete information about your vehicle, including but not limited to make, model, year, license plate number, vehicle identification number (VIN), and whether the vehicle is equipped with Advanced Driver Assistance Systems (ADAS). Pricing and coverage may depend on this information. Providing false or misleading information may result in denial of claims or termination of your Plan.
3.3 Initial Windshield Photo Requirement
To activate coverage under your Plan, you must submit clear, time-stamped photographs of your vehicle’s windshield that clearly show its condition. There is no time limit for providing these photos; however, coverage will not begin until the photos are submitted and approved by Red G Glass Inc. Any damage that exists before the photos are submitted and approved will be considered pre-existing and will not be covered under the Plan.
3.4 Coverage Activation
Your Plan coverage will be activated only after all of the following conditions have been met:
1. You have completed the registration process and provided all required information;
2. You have submitted clear, time-stamped photographs of your vehicle’s windshield that have been approved by Red G Glass Inc;
3. You have paid the applicable Plan fee; and
4. You have received confirmation from Red G Glass Inc that your Plan is active.
4. PAYMENT TERMS AND AUTOMATIC RENEWAL
4.1 Plan Fees
You agree to pay all fees associated with your Plan as specified during the registration process. All fees are non-refundable except as expressly provided in these Terms or as required by applicable law. Red G Glass Inc reserves the right to change the fees for any renewal term with notice as provided in Section 4.4.
4.2 Minimum Term Commitment
Your Plan requires a minimum commitment of twelve (12) consecutive months from the date of activation (“Initial Term”). You are obligated to pay for the entire Initial Term even if you sell your vehicle, stop using the Plan, or fail to submit claims.
4.3 Automatic Renewal
AFTER THE INITIAL TERM, YOUR PLAN WILL AUTOMATICALLY RENEW ON A MONTH-TO-MONTH BASIS UNTIL CANCELED BY EITHER PARTY IN ACCORDANCE WITH THESE TERMS. BY ACCEPTING THESE TERMS, YOU AUTHORIZE RED G GLASS INC TO AUTOMATICALLY CHARGE THE PAYMENT METHOD ON FILE FOR EACH RENEWAL PERIOD UNTIL YOUR PLAN IS CANCELED.
4.4 Price Changes
After the Initial Term, Red G Glass Inc may increase the price of your Plan by providing you with at least thirty (30) days’ prior written notice via email. Such notice will include clear instructions on how to cancel your Plan if you do not agree to the new pricing. If you do not cancel your Plan before the price increase takes effect, you will be deemed to have accepted the new price.
4.5 Renewal Notice
At least thirty (30) days before the end of your Initial Term and before automatic renewal thereafter, Red G Glass Inc will send you a notice via email that includes:
1. The then-current terms of your Plan;
2. The then-current price for your Plan;
3. The date on which your Plan will automatically renew;
4. Instructions on how to cancel your Plan; and
5. The contact information for Red G Glass Inc customer service.
4.6 Non-Refundable Policy
All Plan fees are non-refundable, except as expressly provided in these Terms or as required by applicable law. No refunds will be issued for early cancellation during the Initial Term, partial months of service, or for periods during which you did not submit claims.
5. CLAIMS PROCESS AND PROCEDURES
5.1 Claim Submission Deadline
You must submit a claim for any windshield damage within forty-eight (48) hours of when the damage occurs. Failure to submit a claim within this timeframe may result in denial of your claim. Red G Glass Inc is not liable for any worsening of damage that occurs between the time of the damage and the time of repair or replacement.
5.2 Claim Submission Process
To submit a claim, you must:
1. Submit a claim online at www.redgglass.com;
2. Provide a detailed description of the damage, including when and how it occurred;
3. Submit clear photographs of the damage as requested by Red G Glass Inc; and
4. Provide any additional information or documentation reasonably requested by Red G Glass Inc to evaluate your claim.
5.3 Pre-Approval Requirement
All repairs and replacements must be pre-approved by Red G Glass Inc before any work is performed. Red G Glass Inc will not reimburse you for any work performed without prior written approval. Unauthorized repairs or replacements will not be covered under your Plan and may result in termination of your Plan.
5.4 Partner Shop Requirement
All repairs and replacements must be performed by Red G Glass Inc-designated partner shops. Red G Glass Inc may, at its discretion, assign a specific partner shop for your repair or replacement, or may provide you with a list of approved partner shops from which you may choose. Use of non-approved shops will result in denial of your claim and may result in termination of your Plan.
5.5 No Reimbursement Policy
Under no circumstances will Red G Glass Inc provide reimbursement for repairs or replacements that you pay for directly, even if performed by an approved partner shop. All covered services must be billed directly to Red G Glass Inc by the partner shop.
5.6 Claim Denial and Appeal Procedures
If your claim is denied, Red G Glass Inc will provide you with a written explanation of the reason for the denial. You may appeal a claim denial by submitting a written request for reconsideration within fourteen (14) days of the denial, along with any additional information or documentation that supports your appeal. Red G Glass Inc will review your appeal and provide a final decision within thirty (30) days.
5.7 Quality of Repair Disclaimer
Red G Glass Inc coordinates repair and replacement services but does not perform the actual repairs or replacements. Red G Glass Inc is not responsible for the quality of workmanship, materials, or any other aspect of the repairs or replacements performed by partner shops. Any issues or concerns regarding the quality of repairs or replacements should be addressed directly with the partner shop that performed the work.
6. CANCELLATION AND TERMINATION RIGHTS
6.1 Customer Cancellation Rights
You may cancel your Plan under the following circumstances:
1. After the Initial Term, you may cancel your Plan at any time by submitting a cancellation request online or by providing written notice to Red G Glass Inc at support@tRedGGlass.com. Cancellation will be effective at the end of the current billing period.
2. If Red G Glass Inc increases the price of your Plan as described in Section 4.4, you may cancel your Plan before the price increase takes effect, even if you are still within the Initial Term.
6.2 Red G Glass Inc Termination Rights
Red G Glass Inc may cancel or terminate your Plan at any time, at its sole discretion, with or without cause, upon written or electronic notice to you. If Red G Glass Inc terminates your Plan without cause during the Initial Term, Red G Glass Inc will refund a pro-rated portion of the fees you have paid for the unused portion of your Plan.
6.3 Termination for Cause
Red G Glass Inc may terminate your Plan immediately and without prior notice if:
1. You provide false, misleading, or incomplete information in connection with your Plan or any claim;
2. You submit a fraudulent claim;
3. You use your Plan in a manner that is inconsistent with these Terms;
4. You fail to pay any fees when due; or
5. You otherwise breach these Terms.
Termination for cause will result in immediate cancellation of your Plan with no refund of any fees paid.
6.4 Plan Transfer for Vehicle Replacement
If you replace your covered vehicle with another vehicle that meets the eligibility requirements, you may request a one-time transfer of your Plan to the replacement vehicle within the same coverage class. To request a transfer, you must:
1. Provide proof of sale or transfer of your original covered vehicle;
2. Provide complete and accurate information about your replacement vehicle;
3. Submit clear, time-stamped photographs of your replacement vehicle’s windshield; and
4. Pay any applicable transfer fee or price difference if the replacement vehicle is in a different pricing tier.
Plan transfers are subject to Red G Glass Inc’s approval and are not guaranteed.
6.5 Effect of Termination
Upon termination or cancellation of your Plan for any reason:
1. You will no longer be entitled to any services under the Plan;
2. Any pending claims will be canceled; and
3. You will remain responsible for any fees incurred prior to the effective date of termination.
7. LIABILITY LIMITATIONS AND DISCLAIMERS
7.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RED G GLASS INC’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR PLAN SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO RED G GLASS INC UNDER YOUR PLAN DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
7.2 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RED G GLASS INC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, LOSS OF TIME, INCONVENIENCE, OR ANY OTHER ECONOMIC LOSS, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR PLAN, EVEN IF RED G GLASS INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.3 Exceptions to Limitations
The limitations of liability set forth in this Section 7 do not apply to:
1. Damages arising from Red G Glass Inc’s gross negligence or willful misconduct;
2. Red G Glass Inc’s indemnification obligations under these Terms; or
3. Any other liability that cannot be excluded or limited under applicable law.
7.4 Force Majeure
Red G Glass Inc shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riot, civil unrest, government action, labor disputes, or other events of force majeure. In the event of a force majeure, Red G Glass Inc shall use reasonable efforts to resume performance as soon as practicable.
7.5 Repair Quality Disclaimer
RED G GLASS INC DOES NOT PERFORM REPAIRS OR REPLACEMENTS AND MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, REGARDING THE QUALITY OF WORKMANSHIP, MATERIALS, OR ANY OTHER ASPECT OF THE REPAIRS OR REPLACEMENTS PERFORMED BY PARTNER SHOPS. ANY ISSUES OR CONCERNS REGARDING THE QUALITY OF REPAIRS OR REPLACEMENTS SHOULD BE ADDRESSED DIRECTLY WITH THE PARTNER SHOP THAT PERFORMED THE WORK.
7.6 No Warranties
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, RED G GLASS INC PROVIDES THE PLAN AND ALL SERVICES “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RED G GLASS INC DOES NOT WARRANT THAT THE PLAN OR ANY SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE PLAN WILL BE UNINTERRUPTED OR ERROR-FREE.
8. DISPUTE RESOLUTION AND ARBITRATION
8.1 Binding Arbitration Agreement
YOU AND RED G GLASS INC AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PLAN, INCLUDING THE DETERMINATION OF THE SCOPE OR APPLICABILITY OF THIS AGREEMENT TO ARBITRATE, SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION RATHER THAN IN COURT, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY AND ARE FOR LESS THAN $5,000. THIS AGREEMENT TO ARBITRATE IS INTENDED TO BE BROADLY INTERPRETED AND INCLUDES, WITHOUT LIMITATION, CLAIMS BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY.
8.2 Arbitration Procedures
The arbitration will be conducted by either the American Arbitration Association (“AAA”) or JAMS, at your election, under their respective rules and procedures, as modified by these Terms. The Federal Arbitration Act and federal arbitration law apply to these Terms. The arbitration shall be conducted by a single arbitrator with substantial experience in resolving consumer-related disputes. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator shall have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law. The arbitrator shall issue a written award and statement of decision describing the essential findings and conclusions on which the award is based.
8.3 Costs of Arbitration
The cost of arbitration shall be shared between you and Red G Glass Inc as follows: (a) you will be responsible for paying the lesser of $250 or the filing fee that would be applicable in the appropriate court of law; and (b) Red G Glass Inc will pay all other arbitration fees and costs, including the arbitrator’s fees. Each party shall bear its own attorneys’ fees and costs unless the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for an improper purpose, in which case the arbitrator may award attorneys’ fees and costs as permitted by applicable law.
8.4 Small Claims Court Option
Notwithstanding the foregoing, either you or Red G Glass Inc may bring an individual action in small claims court for disputes or claims within the scope of that court’s jurisdiction if the amount in controversy is less than $5,000.
8.5 Class Action Waiver
YOU AND RED G GLASS INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Red G Glass Inc agree otherwise, the arbitrator may not consolidate more than one person’s claims with your claims and may not otherwise preside over any form of a representative or class proceeding.
8.6 Venue for Arbitration
Any arbitration shall take place in Salt Lake County, Utah, unless you and Red G Glass Inc agree otherwise or unless the elected arbitration provider’s rules require otherwise.
8.7 Opt-Out Right
You have the right to opt out of this arbitration agreement by sending written notice to Red G Glass Inc at PO Box 766 Magna, UT 84044 or support@redgglass.com within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you do not wish to resolve disputes with Red G Glass Inc through arbitration. If you opt out of this arbitration agreement, all other parts of these Terms will continue to apply.
8.8 Survival
This arbitration agreement will survive the termination of your relationship with Red G Glass Inc.
9. PRIVACY AND DATA COLLECTION
9.1 Data Collection Practices
Red G Glass Inc collects and processes personal information as necessary to provide the services under your Plan, including but not limited to:
1. Contact information (name, address, email, phone number);
2. Vehicle information (make, model, year, VIN, ADAS status);
3. Payment information;
4. Claim information, including photographs of damage; and
5. Communications between you and Red G Glass Inc.
9.2 Use of Personal Information
Red G Glass Inc uses your personal information to:
1. Provide services under your Plan;
2. Process and evaluate claims;
3. Communicate with you about your Plan;
4. Process payments;
5. Improve our services; and
6. Comply with legal obligations.
9.3 Third-Party Sharing
Red G Glass Inc may share your personal information with:
1. Partner shops that perform repairs or replacements under your Plan;
2. Service providers that assist in providing services under your Plan;
3. Payment processors to process your payments;
4. Legal and regulatory authorities as required by law; and
5. Professional advisors such as lawyers, auditors, and insurers.
9.4 Privacy Policy
For more detailed information about our data collection and processing practices, please review our Privacy Policy at www.getRed G Glass Inc.com/privacy, which is incorporated into these Terms by reference.
9.5 Utah Consumer Privacy Act Compliance
In accordance with the Utah Consumer Privacy Act (Utah Code § 13-61-101 et seq.), you have the right to:
1. Access the personal information we collect about you;
2. Request deletion of your personal information;
3. Opt out of the sale of your personal information; and
4. Non-discrimination for exercising your privacy rights.

10. CUSTOMER RESPONSIBILITIES AND INDEMNIFICATION
10.1 Accurate Information
You are responsible for providing accurate and complete information about yourself and your vehicle. You represent and warrant that all information you provide to Red G Glass Inc is true, accurate, current, and complete, and you agree to update such information as necessary to maintain its truth and accuracy.
10.2 Compliance with Terms
You agree to comply with these Terms and any other policies or guidelines provided by Red G Glass Inc in connection with your Plan. You agree to use your Plan only for its intended purpose and in accordance with these Terms.
10.3 Cooperation with Claims Process
You agree to cooperate fully with Red G Glass Inc in the processing of any claim, including but not limited to:
1. Providing accurate and complete information about the damage;
2. Submitting clear photographs of the damage;
3. Making your vehicle available for inspection if requested;
4. Following Red G Glass Inc’s instructions regarding repair or replacement; and
5. Providing any additional information or documentation reasonably requested by Red G Glass Inc.
10.4 Indemnification
You agree to indemnify, defend, and hold harmless Red G Glass Inc and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or relating to:
1. Your material misrepresentation or fraud in connection with your Plan or any claim;
2. Your violation of these Terms;
3. Your violation of any rights of another person or entity; or
4. Your use of your Plan in a manner not permitted by these Terms.
This indemnification obligation does not apply to claims arising from Red G Glass Inc’s own negligence or willful misconduct.
11. GENERAL PROVISIONS
11.1 Governing Law
These Terms and your Plan shall be governed by and construed in accordance with the laws of the State of Utah, without giving effect to any principles of conflicts of law. Any dispute between you and Red G Glass Inc that is not subject to arbitration shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah.
11.2 Entire Agreement
These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Red G Glass Inc with respect to your Plan and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Red G Glass Inc with respect to your Plan.
11.3 Severability
If any provision of these Terms is held to be invalid, illegal, void, or unenforceable by any court or tribunal of competent jurisdiction, the remainder of these Terms shall remain in full force and effect to the maximum extent permitted by law. The parties agree that any such invalid, illegal, void, or unenforceable provision shall be modified and limited in its effect to the extent necessary to cause it to be enforceable, or if such modification is not possible, shall be deemed severed from these Terms. In such event, the parties shall negotiate in good faith to replace any invalid, illegal, void, or unenforceable provision with a valid, legal, and enforceable provision that corresponds as closely as possible to the parties’ original intent and economic expectations. The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of such provision in any other jurisdiction.
11.4 No Waiver
The failure of Red G Glass Inc to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Red G Glass Inc. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
11.5 Assignment
You may not assign or transfer these Terms or your Plan, by operation of law or otherwise, without Red G Glass Inc’s prior written consent. Any attempt by you to assign or transfer these Terms or your Plan without such consent will be null and void. Red G Glass Inc may assign or transfer these Terms or your Plan, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
11.6 Notices
Any notices or other communications provided by Red G Glass Inc under these Terms, including those regarding modifications to these Terms, will be given: (a) via email to the email address you provide; or (b) by posting to the Red G Glass Inc website. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
11.7 Survival
The following provisions will survive the termination or expiration of these Terms: Sections 7 (Liability Limitations and Disclaimers), 8 (Dispute Resolution and Arbitration), 10.4 (Indemnification), and 11 (General Provisions).
